Dear FSGA Members,

As we head into the final stretch of summer, I’m excited to share several key updates on initiatives that are shaping the future of our organization and the fantasy sports and gaming industry at large.

First, I’m pleased to announce the formation of the Website Redesign Task Force, which has been charged with overseeing the development of a new, modernized FSGA website. Our goals include improving the user interface, making content easier to discover and access, and introducing new features to better serve our members. This is a critical step forward toward enabling the FSGA to meet our strategic objectives of Influential Brand and Trusted Research.  We have a vision for the website to be our industry’s digital hub for insight, advocacy, and community.

On the advocacy and government affairs front, we continue to prioritize protecting the interests of our members. We are closely evaluating grassroots strategies in response to the recent DFS legal opinion issued by California’s Attorney General and are preparing guidance to help members navigate any enforcement actions that may arise. On a more positive note, we were pleased to see that last month’s passage of the so-called “big beautiful bill” did not negatively affect fantasy sports or gaming at the federal level. Two areas we are watching closely are (1) the 90% cap on gaming losses; and (2) the increase of the reporting threshold for 1099’s (increasing from $600 to $2000). While these will affect individual players’ tax compliance, it is worth understanding the impact to your players. Additionally, there are tax law changes that may benefit business owners, so meet with your tax advisor to discuss the changes and their impact on your business returns.

Additionally, in a major step forward for our policy efforts, we have retained Miller & Chevalier to represent the industry before the IRS in seeking favorable guidance on how the Section 4401 excise tax applies to fantasy sports. As part of this effort, we’re collecting information from members about any audit experiences. This data will be instrumental in advocating for the IRS to dedicate resources to this issue and pursue a formal guidance project.

In other news, our community continues to grow and evolve. We’ve recently added three new channels to the FSGA Slack for deeper discussions on #prediction-markets, #sweepstakes, and #casinos. We encourage all members to join the conversation and connect with peers exploring these fast-evolving sectors. 

Looking ahead to 2026, our Winter Conference (Feb. 17–18, 2026 at Circa in Las Vegas) will focus on marketing and branding - a theme chosen to equip attendees with practical strategies to grow their business, expand offerings, and connect with new audiences. We’re building a program filled with actionable takeaways and forward-thinking content that reflects where our industry is headed. We will be sharing more in the coming weeks and months as sessions and speakers are finalized. 

Finally, to help shape the future of the FSGA as we look to the new year, we’ve launched our annual member survey, sent via SurveyMonkey to all contacts of each member company. If you haven’t yet had a chance to respond, I encourage you to take the 15 minutes—it’s one of the most direct ways you can have an impact on shaping member benefits, our research studies, and the education we provide.
